RULES AND REGULATIONS-HEATHER GLEN CONDOMINIUM

Satellite Dishes
Satellite Dishes may be installed provided you follow the following guidelines: You must send written notice to the Board of Trustees c/o Midstate Management Corporation of your intent to install a satellite dish. Installation is limited to within your deck area. All wires must immediately enter the unit. You are not permitted to have wires draping across the roofs or hanging loose down the sides of the building. For further information regarding the installation of satellite dishes, please contact Midstate Management Corporation.
Garbage/Recycling Reminders
Garbage: The brown garbage dumpster located near your building is for trash ONLY. Pick-up will be on every Monday and Thursday. All garbage MUST be placed inside the dumpster. Nothing should be placed on the ground.

* Plastic

There are recycling containers located near your building for glass, aluminum and plastic. All tops must be removed from glass containers. Please do NOT throw any plastic bags in these receptacles. Pick-up will be every Wednesday. Paper Newspapers must be placed within the appropriate marked dumpster. Paper is picked up 8:00 a.m. every Thursday.

* Bulk Items

All cardboard must be broken down and placed in the appropriately labeled dumpster. Pick-up is every Thursday. Entrances and Hallways are NOT to be used for storage of trash recycling. All items must be stored within your unit. Bulk items are picked up weekly on Thursday (i.e., appliances, beds, sofas, etc.) All other items should be placed inside the dumpster.
Rug Replacement
Unit owners are responsible for insuring that discarded rugs are cut into appropriate sizes to fit in the dumpster designated for garbage items. Do not dump discarded rugs in the recycling dumpsters.
Unit owners who soil the rugs will be subject to a daily fine of $25, until the rugs are cleaned. If the unit owner does not clean the soiled rug(s), the Board will have the rug(s) cleaned and the expense related to the cleaning charged back to the Unit Owner. To avoid fines and the expense of cleaning rugs, each Unit Owner should use extra care to avoid soiling the carpets.
Barbecue Grill Regulation
The permitted use will be electric grills that have been approved under the Uniform Fire Safety Code for indoor use.The fire marshal stated that fines of up to $5,000 is mandated by the State for any occupant of a building that creates conditions in violation of this code by virtue of storage, handling and use of substances and appliances that can cause a fire.The Fire Marshall will periodically inspect the area to insure compliance.
Holiday Decorations
The Board has approved the following guidelines drawn up by the Architectural Committee for holiday decorating. Please follow them and if there are any questions, call Midstate Management Corporation.

Holiday Christmas Trees: The Board does not recommend live Christmas trees as they present a danger of fire as they dry out. If you do have a live tree, it is important to keep the tree moist by adding water to the tree base. Lighted candles should never be placed on a tree or located near a tree. Please be sure to properly dispose of the tree after the holidays and care should be taken to avoid leaving needles on the hall carpeting.
1. Decorations may be displayed only between December 1st, and January 8th of the New Year.

2. All lights must be approved for outdoor use and have a UL rating.

3. Lights must be affixed to trim only and should not be attached to metal siding, doors, gutters or windows. Decorating the common building area is not permitted. No decorations are to extend past the balcony nor are they to be attached to the railing.

4. Lights may not be placed in trees, shrubbery or any other planting in the common areas.

5. Ornamental wreaths and other decorations are permitted on unit doors and inside windows.

6. No lawn ornaments or roof-mounted figures will be permitted.

7. No permanent alterations should be made to any building element.

8. Exterior spotlights are not permitted.

9. No noise generating displays will be permitted.
Resolution Regarding Parking
Article V, Section 5.01 of the By- Laws states that the Board of Directors shall have all powers as set forth in the By- laws together with such other powers as provided in the Master Deed or by law or those which may be implied; and

Article V, Section 5.01 (e) of the By- Laws permits the Board of Directors to adopt, amend and publish rules and regulations covering the operation and use of the common elements; and

Article V, Section 5.01 (h) authorizes the Board to establish and enforce Rules and Regulations for parking by, and the assignment of parking spaces to the Unit Owners; and

Section 5.01 of the Master Deed of the Heather Glen Condominium Association provides that the use of the common parking areas shall be subject to the Rules and Regulations of the Association; and

In accordance with the restrictions contained in Section 11 of the Master Deed at 11 .01(d) no trailer, tractor, truck (commercial or unregistered), mobile home, recreation vehicle, boat, boat trailer or the like shall be stored, housed or parked on the Property, except that this restriction shall not apply to vehicles stored on the property by the Developer, the Association and/or Management for use in maintaining the property; and The Board desires to provide definitions of those vehicles that are prohibited on the premises and to clarify the restrictions contained in the Master Deed and By- laws.

The Board hereby adopts the following regulation with regard to parking at the Association:

At no time may any person park an abandoned vehicle, illegally parked vehicles, inoperable vehicle, recreational vehicle, or an unregistered vehicle anywhere on association property. At no time may any person park a commercial vehicle or oversized vehicle overnight on association property.

(1)Abandoned Vehicle Defined:

A vehicle will be deemed abandoned if it is left un operated in any non-assigned parking space for a period of 14 consecutive days.

(2)Commercial Vehicle Defined:

(a) A Commercial Vehicle is any vehicle, which contains one or more of the following with the exception of commercial plates in which case commercial plates plus any one of the following:

- ladders, tools, plows, or the like, on the exterior

- racks or equipment which is primarily utilized for the transportation of machinery and/or equipment - any vehicle with more than two axles - any vehicle with an overall length greater than fourteen (14) feet, an overall width greater than six (6) feet OR an overall height greater than eight (8) feet OR any vehicle which length or width exceeds the width or length of a standard parking space such as the spaces at the Association.

(b) The term Commercial Vehicle includes, but is not limited to: trailers, tractors, buses, livery and construction vehicles.

(3) Illegally Parked Vehicle Defined:

(a) A vehicle is illegally parked if it is not parked within the I lined parking stalls or if the vehicle extends beyond the end of the stall.

(b) A vehicle shall be deemed to be illegally parked if it is parked in violation of any Association, municipal, state or federal law or regulation.

(c) A vehicle is illegally parked if it has an open cargo area AND

(1) it contains cargo taller than the cargo bay walls;

(2) it contains cargo which is not contained to prevent spillage;

OR

(3) it contains cargo which is toxic, is offensive in smell, or in which in any way poses a hazard to the community or any persons living therein.

(4) Inoperable Vehicle Defined:

An Inoperable Vehicle is a vehicle, which is physically unable to travel under its own power. Any vehicle which has a flat tire for more than 48 hours shall be deemed an Inoperable Vehicle. Any vehicle, which is placed on blocks for any amount of time shall be deemed an Inoperable Vehicle.

(5)Oversized Vehicle Defined:

An Oversized Vehicle is defined as any vehicle with an overall length greater than sixteen (16) feet, an overall width greater than six (6) feet OR an overall height greater than eight (8) feet OR if the vehicle does not fit into a standard parking space.

(6)Recreational Vehicle Defined:

A Recreational Vehicle is defined as any vehicle designed or intended to be used primarily for off-road travel or as a temporary or permanent resident. This definition includes, but is not limited to, mobile homes, boats, boat trailers, and snowmobiles.

(7)Unregistered Vehicle Defined:(a) A vehicle shall be deemed to be unregistered if it does not have a valid registration sticker and/or a valid license plate. A vehicle, which has a temporary inspection sticker, shall not be considered an Unregistered Vehicle, provided that the temporary sticker has not expired. A vehicle, which bears a temporary license plate, shall not be considered an Unregistered Vehicle, provided that the temporary license plate has not expired. Any vehicle, which is covered by a tarpaulin, shall be reputably presumed to be an Unregistered Vehicle.
(b) All vehicles must be parked within a lined space. Any vehicle not parked in a lined parking space shall be subject to towing and fines as set forth herein.
(c) Any parking restriction may be waived by the Board of Directors upon application by a unit owner and/or tenant and upon a showing of good cause. Upon any application by a tenant, a copy shall be forwarded to the unit owner.
2. PARKING VIOLATIONS Any vehicle, which is parked in violation of the rules and regulations of the Association, is subject to towing and/or the imposition of fines by the Association.(a). TOWING(1) The costs of towing any vehicle parked in violation of any Association regulation shall be the responsibility of the vehicle owner.(2) Any vehicle, which creates an unsafe condition, is subject to IMMEDIATE towing. Any vehicle, which is parked on association property in any location other than a marked parking space, is deemed to be parked in an unsafe condition.(3) Neither the Association, the Board of Directors, nor the Managing agent shall be liable to the unit owner, the owner of the improperly parked vehicle, or to the person otherwise responsible for the vehicle for any damage and/or injuries which occur during or as a result of the removal of such vehicle from the property.(4) Upon having any vehicle towed from the property the Association will notify the Helmetta Police Department.
Use of Parking Lots
The parking lots in the Condominium are common elements and therefore subject to the rules and regulations of the Board of Trustee's. The Board has prohibited the washing of cars, playing ball and the use of the parking lots for any other purpose than to park cars. Violators are subject to fine.

Resolution Regarding Screen Doors

The Board of Directors has determined that it would be beneficial to the unit owners to be permitted to have screen doors for the door openings onto the deck or balcony of each unit.

1. Unit owners are permitted to install screen doors at the door openings to the deck or balcony of each unit in accordance with the following specifications:
* Gray Building - White Doors
* Tan Building - Almond Doors
2. Each unit owner who wished to install such a screen door shall do so at his own cost and expense.
3. Each unit owner shall be responsible for the maintenance, repair and/or replacement of the screen door at his sole cost and expense.
4. No screen door shall be installed, maintained, repaired and/or replaced except in accordance with the standards and specifications as set forth hereof.
5. If the aforesaid door is not properly maintained and/or repaired, the Association shall have the right, but not the obligation, to perform such maintenance and/or repair at the expense of the unit owner.
6. The aforesaid door shall be part of the unit and shall not be personality of the unit owner. Upon conveyance of title to the unit, the door shall remain as part of the unit.

Resolution Prohibiting Storage Of Personal Belongings
In The Common Hallways


The Board of Directors has adopted regulations covering the details of the operation and use of the Common elements. Residents shall not use the common hallways to store personal belongings which would create a potential safety hazard, possibly resulting in a liability suit against Association.

The storing of personal belongings deters from the aesthetic appearance of the building. Therefore, the storing of personal belongings in the common hallways is strictly prohibited. All items found in the common hallways will be tagged with a five (5) day grace period in which to be removed. If the tagged item is not removed by the end of the Fifth day, the item will be confiscated and stored at the sole expense of the Owner.

The personal belongings will be kept in storage for approximately 30 days at a rate one dollar ($1.00) per day storage fees. The Owner will be required to contact the Association to recover the confiscated item.Offenders will be in violation of the governing document and subject to a $25.00 fine per day, in addition to storage fees.

Window Replacement and Repair
Windows are the unit owners responsibility. Rules require that all window replacement be consistent with the color and design of the existing windows. As such, below is some information on window companies. The use of these service providers does not constitute a recommendation by the Board of Trustees.
